What it is

CMMC Phase 2 (third-party assessment): under Reform Task Force review, suspended July 2026. CMMC Phase 1 (self-assessment + affirmation): active now, annual requirement continues. The audit timing moved. The obligation to attest didn’t.

Who’s actually impacted

Roughly 80,000 contractors and subcontractors in the defense supply chain. Flow-down means primes push the requirement to their subs, so even small shops get pulled in.

The dates

The Department of War suspended the mandatory third-party CMMC assessment in July 2026 pending review. Self-assessment, SPRS score submission, and the annual affirmation under DFARS 252.204-7021 are still active and still due.

The teeth

The affirmation is a federal record you’re personally putting your name to. DIBCAC can still show up and ask you to prove what you affirmed.

What it is

A CMS rule forcing health plans to speed up prior authorization and share data through standard FHIR APIs.

Who’s actually impacted

Medicare Advantage, Medicaid, CHIP, and marketplace plans, and downstream, the providers and vendors who plug into them.

The dates

Operational rules live since Jan 1, 2026: decisions within 72 hours (expedited) / 7 days (standard), a specific reason for every denial, metrics reporting. The four FHIR APIs must be in production by Jan 1, 2027.

The teeth

Decision-timer compliance is mandatory now, with public metrics reporting. Missing the API deadline puts a plan out of compliance with a federal rule.

Why SpecOps

What it is

The EU’s comprehensive AI law. It sorts AI by risk; “high-risk” uses (hiring, credit, medical, critical infrastructure) carry heavy obligations.

Who’s actually impacted

The catch: it’s extraterritorial, like GDPR. If your AI’s output touches someone in the EU, you’re in scope even if you’re entirely US-based.

The dates

High-risk obligations were set for Aug 2, 2026 but were deferred to Dec 2, 2027 under the 2026 Digital Omnibus (embedded-product AI to Aug 2028). The obligations themselves, risk management, logging, human oversight, post-market monitoring, did not change.

The teeth

Fines up to €35M or 7% of global revenue.

What it is

Live since March 31, 2025, when the 51 future-dated requirements became mandatory. Every 2026 assessment scores the full standard: MFA for all cardholder-data-environment access, plus a software inventory for custom code.

Enforced by the card brands. Non-compliance risks fines, higher transaction fees, and losing the ability to process cards.

What it is

New York’s aggressively enforced cybersecurity regulation for financial firms, plus the SEC’s scrutiny of how firms disclose AI use and AI-related risk.

Who’s actually impacted

Any entity licensed by NYDFS, banks, insurers, and brokers, not just big banks, and any SEC-registered firm making AI claims. NYDFS said in Oct 2024 that AI-related cyber risk, including from your own AI, is already in scope.

The dates

Part 500’s final phase (universal MFA + asset inventory) took effect Nov 1, 2025; the first certification reflecting it is due April 15, 2026. The SEC has pursued “AI-washing” enforcement against firms overstating AI.

The teeth

Personal liability: CEOs and CISOs personally certify compliance. Fines up to $30M (a $2M settlement with a small insurance agent in Aug 2025 shows even small firms are targets).

What it is

M-25-21 issued April 2025; ongoing. Agencies must inventory AI use cases, designate Chief AI Officers, and apply risk-management practices to high-impact AI.

Non-conforming AI can’t be deployed in-agency. For a vendor, failing the governance bar means your AI doesn’t get bought.
